My123free is Back Up

Well, it's sort of back up. They put the site back up because I guess lot of people was complaining. It's been 3 months now since I ordered my Nintendo DS from them and still haven't got it. I email them about it and was told it will be sent out, they are just sending out the rewards slow. The are in breach of their contract so to speak. On their site it states:
"Prize redemption
My 123 Free will strive to provide stated gift in a timely manner. If selected gift is not available, another gift of equal value may be substituted with user agreement. All gift requests made before the end of the month will be paid on or around the 25th of the following month."

The 25 of the the next month has pasted 2 months ago. I also told them that in the email and they didn't even respond to that. I'm hoping this isn't a scam site, but I'm pushing to believe it is. Sorry.
